1. Introduction and Agreement

These Terms of Service ("Terms") govern your use of the website operated by TrustGuard Solicitors ("TrustGuard Solicitors", "we", "us", "our") at trustguard-solicitors.eu, and your engagement with our services. By accessing our website or instructing us to act on your behalf, you agree to be bound by these Terms. If you do not accept these Terms, please do not use our website or services.

2. Description of Services

TrustGuard Solicitors provides case assessment, evidence preparation, regulatory complaint filing, chargeback assistance, case management, and coordination with affiliated legal professionals to assist victims of investment and broker fraud in recovering their funds. Our services are delivered from our Brussels office and through our pan-European affiliate network.

TrustGuard Solicitors does not itself provide regulated legal advice or legal representation. Legal services referenced or described in connection with our work are provided exclusively by qualified independent legal professionals affiliated with our network, under separate engagement terms with those professionals.

3. No Guarantee of Outcome

While TrustGuard Solicitors has a strong track record of assisting clients with fund recovery, we cannot guarantee that any particular case will result in recovery. Recovery outcomes depend on factors outside our control, including the broker's jurisdiction, available assets, regulatory responsiveness, and the strength and nature of available evidence. All case outcomes referenced on our website are illustrative only and do not imply that identical or similar results will be achieved in any future case.

4. Client Obligations

In engaging our services, you agree to:

  • Provide complete, accurate, and truthful information about your case and background.
  • Provide all requested documentation promptly and cooperate fully with our team and affiliated professionals.
  • Inform us promptly of any material developments in your case, including contact from the broker, regulators, or financial institutions.
  • Refrain from taking independent action regarding your case without prior discussion and agreement with us.
  • Maintain confidentiality with respect to the strategies and information we share with you in connection with your case.

5. Fees and Payment

Our fee arrangement is agreed individually with each client prior to the commencement of any chargeable work. For qualifying cases, our remuneration is structured as a success fee — a percentage of funds recovered on your behalf — payable only upon confirmed recovery. The precise percentage is set out in your client agreement. Any third-party costs (including court fees, expert witness fees, or regulatory filing fees) that fall outside our success fee arrangement will be disclosed to you in advance and require your written approval before being incurred.

6. Intellectual Property

All materials on our website — including text, graphics, logos, and published content — are the property of TrustGuard Solicitors or its content licensors and are protected under applicable intellectual property law. Unauthorised reproduction, distribution, or derivative use of any website content is prohibited without our express prior written consent.

7. Limitation of Liability

To the maximum extent permitted under applicable Belgian and EU law, TrustGuard Solicitors shall not be liable for indirect, consequential, special, or incidental damages arising from your use of our website or the outcome of recovery efforts undertaken on your behalf. Our aggregate liability for any claim arising under these Terms shall not exceed the total fees actually paid by you to TrustGuard Solicitors in connection with the relevant matter.

8. Confidentiality

We maintain strict confidentiality with respect to all information you provide in connection with your case. Information is disclosed to third parties only to the extent necessary to pursue your recovery or to comply with a legal obligation. All affiliated professionals and service providers engaged in your case are bound by equivalent confidentiality obligations.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of Belgium, without prejudice to any mandatory consumer protection provisions applicable in your country of residence. Any dispute arising from these Terms or our services that cannot be resolved amicably shall be subject to the jurisdiction of the courts of Brussels, Belgium, unless applicable EU consumer protection law provides otherwise.

10. Amendments

We may revise these Terms from time to time. The most current version will always be published on our website. Continued use of our website or services following any revision constitutes acceptance of the updated Terms.
